Terms of Service

These Terms of Service govern access to and use of damru.shop and purchases made from Damru. They are designed for Damru's curated, small-batch, natural, handcrafted and made-to-order products. Please read them together with our Privacy Policy, Shipping Policy, and Return, Replacement and Damage Policy.

By visiting, interacting with or using our website or purchasing from us, you agree to these Terms. If you do not agree, please do not use the website or place an order. Nothing in these Terms limits any right or remedy that cannot lawfully be limited under applicable consumer-protection law.

Section 1 About Damru and the Services

Damru is a trading brand operated by Ravi Naik. In these Terms, the words 'Damru', 'we', 'us' and 'our' refer to Damru and Damru as applicable. 'Customer', 'you' and 'your' refer to the person accessing the website or purchasing a product.

Damru operates this store and website, including its information, content, features, products and customer-support services. The store is powered by Shopify, which provides the technology that enables us to offer these services.

Section 2 Eligibility and Customer Accounts

You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you allow a minor to browse the website using your device, you remain responsible for that use. A minor must not place an order without the involvement and consent of a parent or lawful guardian.

You agree to provide complete, current and accurate account, contact, billing, payment and shipping information. You are responsible for protecting your account credentials and for activity carried out through your account. You must promptly notify us if you believe your account has been used without permission.

Section 3 Products and Natural Characteristics

Damru offers products that may include Sphatik, Rudraksha, gemstones, malas, bracelets, Yantras, metal ritual articles and other natural or handcrafted items. Many products are individually selected, made in small batches, handmade, hand-finished or created from natural materials.

Natural products are not visually identical. Inclusions, internal lines, veils, mineral deposits, grooves, pores, shade, transparency, texture, shape and minor differences in dimensions or weight can occur naturally. These characteristics are part of the identity of the material and are not, by themselves, damage or manufacturing defects.

Measurements and weights are stated as accurately as reasonably possible but may be approximate unless expressly confirmed as exact. Handmade products can show minor variations resulting from the making and finishing process.

We make reasonable efforts to display products accurately. Colour, brightness, transparency and scale may appear different because of photography, lighting, screen settings or device type. Where a listing expressly states that the exact photographed piece will be supplied, we will supply that piece subject to availability and order acceptance. Otherwise, photographs may be representative of the product type and grade.

Section 4 Product Information and Traditional Use

Product descriptions, articles, videos, consultations and other content relating to spiritual, ritual, Vastu, astrological or traditional uses are provided for cultural, educational and informational purposes. Such information may reflect traditional beliefs and practices and should not be understood as a promise of a particular outcome.

Damru does not guarantee wealth, profit, business success, health improvement, protection, relationship outcomes, astrological results or any other specific result from purchasing, wearing, placing or using a product. Individual beliefs, practices and experiences vary.

Our content and products are not substitutes for medical diagnosis or treatment, mental-health care, legal advice, financial advice or other regulated professional services. Customers should consult an appropriately qualified professional when such advice is needed.

Section 5 Orders and Acceptance

Submitting an order is an offer to purchase. An automated order acknowledgement does not necessarily mean that we have accepted the order. Acceptance occurs when we confirm the order, receive any required payment or advance, and begin fulfilment or dispatch.

We may decline, hold or cancel an order for legitimate reasons, including suspected fraud, incorrect pricing, payment failure, stock unavailability, inability to fulfil a custom specification, serviceability restrictions or violation of these Terms. If we cancel an accepted prepaid order before fulfilment, we will return the amount received for the cancelled product and any unprovided service, subject to applicable law.

Retail purchases are intended for personal use, gifting or household use. Products may not be commercially resold using Damru's name, photographs, certificates, branding or representations without our written approval. This restriction does not prevent an authorised wholesale, distribution or export arrangement agreed separately in writing.

Section 6 Customised and Made to Order Products

A 'Custom Product' means a product made, altered, assembled, selected, reserved, procured or specially sourced according to a customer's instructions or approved specifications. This includes requests relating to dimensions, weight, stone, base, finish, engraving, name or text, mala length, bracelet size, bead combination, design, mounting, packaging or special sourcing.

Before work begins, we may confirm specifications, price, estimated timeline and payment terms through the website, invoice, email, telephone or WhatsApp. The customer's written or recorded approval, together with the required payment or advance, authorises Damru to begin the work.

Once production, alteration, reservation or special sourcing has begun, a Custom Product cannot be cancelled, returned or exchanged because of a change of mind, preference or a later change in requirements. If the customer supplied an incorrect measurement or specification and we followed the approved information, alteration or remaking may be chargeable and subject to feasibility.

The final-sale nature of a Custom Product does not remove the customer's right to an appropriate resolution if the product is received physically damaged in transit, if Damru supplies the wrong product, or where a remedy is required by applicable law.

Section 7 Prices, Taxes and Charges

Prices, discounts and promotions may change without notice. The applicable product price is the price confirmed when the order is accepted, except where there is an obvious error that we correct before fulfilment.

Unless expressly stated otherwise, listed product prices do not include shipping, Cash on Delivery service charges, customs duties, import taxes, local handling fees or other destination-based charges. Taxes will be charged where applicable and shown on the invoice or checkout as required.

Shipping charges are borne by the customer and vary according to the delivery address, PIN code, parcel weight, dimensions, product value, service level and courier availability. Any applicable Cash on Delivery charge is also borne by the customer. Final charges will be displayed at checkout or communicated before order confirmation.

Section 8 Payment and Cash on Delivery

You confirm that you are authorised to use the payment method provided and that the information supplied is accurate. Available payment methods may include UPI, bank transfer, cards, payment gateways and Cash on Delivery, subject to availability.

Cash on Delivery is available only for eligible products, values and serviceable locations. COD orders may require confirmation by telephone or WhatsApp. We may require partial or full advance payment for Custom Products, high-value orders, specially sourced products or orders presenting an increased return-to-origin risk.

Bank, payment-gateway, COD and other service charges may be non-refundable once the relevant service has been provided, except where a refund is required by applicable law or expressly approved by Damru.

Section 9 Shipping and Delivery

Ready-to-ship products are generally dispatched within the timeframe stated on the website or order confirmation. Custom Products and specially sourced products require additional time, which will be communicated before or during order confirmation.

Delivery dates are estimates, not guarantees. Delays may occur because of courier operations, routing, customs, weather, public holidays, local restrictions, accidents, natural events or circumstances outside our reasonable control.

Tracking details will ordinarily be shared after dispatch. Tracking events are generated by the courier and may not update in real time. Customers should contact Damru if a shipment shows an unusual delay or exception.

Courier Accidents and Transit Exceptions

If tracking reports a vehicle accident, route disruption, damaged consignment, operational exception or another serious transit event, Damru will raise an investigation with the courier partner. Such a status does not automatically establish that the individual parcel is lost or damaged.

During an active investigation, we may wait for the courier to recover, inspect, deliver, return or officially classify the shipment before determining the resolution. A temporary delay or tracking interruption does not, by itself, cancel the order.

If the courier confirms that the shipment is safe, delivery may continue. If the courier officially confirms that the shipment is lost, destroyed or damaged beyond delivery, Damru will arrange a replacement without additional shipping or COD charges. If a suitable replacement is not reasonably available, we will offer an appropriate alternative, store credit or refund, having regard to the product, the customer's preference and applicable law.

Incorrect Address and Failed Delivery

The customer is responsible for providing a complete and accurate address, PIN code and active telephone number. Address changes can be accepted only before dispatch and cannot be guaranteed after handover to the courier.

If delivery fails because of an incorrect or incomplete address, an unavailable recipient, an unreachable telephone number, repeated failed attempts or refusal to accept the parcel, the customer may be required to pay the forward, return-to-origin and re-dispatch charges. Refusal of delivery does not make a Custom Product refundable.

Section 10 Returns, Exchanges and Damage Claims

Purchases are subject to our Return, Replacement and Damage Policy, which forms part of these Terms. Damru does not accept routine returns or exchanges for change of mind, personal preference, natural variation or a request for a different product after delivery.

Custom Products are final sale and do not qualify for return or exchange, subject to the damage, incorrect-product and mandatory legal remedies stated in these Terms and the applicable policy.

Transit Damage

A replacement may be offered when a product is received physically broken or damaged in transit and the claim is verified. The customer must contact Damru within 48 hours of delivery and provide the order number, clear photographs and a continuous, unedited unboxing video beginning with the sealed courier package. The video should clearly show the shipping label, package seals, all sides of the package, the complete opening process and the condition of the product immediately after opening.

The customer must retain the product, box, protective materials, accessories, invoice and certificates until the claim is resolved. Damage caused after delivery through dropping, misuse, unsuitable cleaning, chemical exposure, improper storage, alteration or ritual use is not transit damage.

Where a courier has independently confirmed loss or destruction before delivery, an unboxing video is not required. Where applicable law requires consideration of other reliable evidence, Damru will review that evidence fairly.

Wrong Product or Material Difference

If Damru supplies a product different from the confirmed order, the customer must notify us promptly, preferably within 48 hours, and provide the order details and available unpacking evidence. After verification, we will arrange an appropriate correction at no additional shipping cost.

Natural characteristics, minor permitted tolerances and screen-related colour differences described in Section 3 are not treated as damage or incorrect supply. This clause does not excuse a material error in the product supplied or description provided.

Section 11 International Orders

International shipping charges are determined separately according to destination, weight, dimensions, declared value, service level and import requirements. International customers are responsible for customs duties, import taxes, brokerage, local handling fees and compliance with destination-country requirements unless we expressly agree otherwise in writing.

Customs processing can delay delivery. If an international parcel is refused, abandoned or returned because the customer did not pay destination charges or provide required information, the customer remains responsible for shipping, customs, return and related charges. Any available refund for an eligible non-custom product will be considered only after the parcel is safely returned and inspected, less non-recoverable charges, subject to applicable law.

Section 12 Product Care and Safe Use

Customers must follow any care, handling, placement and safety instructions supplied with a product. Natural stone and crystal items can be fragile and may chip, crack or break if dropped, struck, exposed to sudden temperature changes or treated with unsuitable chemicals.

Products intended for spiritual, decorative or ritual use must be kept away from children and used responsibly. Small beads, findings and accessories can present a choking hazard. Damru is not responsible for damage or injury caused by use contrary to supplied instructions, unreasonable misuse or unauthorised alteration, except to the extent liability cannot lawfully be excluded.

Section 13 Authenticity, Testing and Certificates

Where a product is sold with a laboratory report or certificate, the report relates only to the item or sample identified in that report and is subject to the issuing laboratory's methods, scope, terms and limitations. A certificate does not constitute a guarantee of spiritual, astrological, health or financial results.

Customers should review the listing to understand whether certification is included. Independent testing requested after purchase is not reimbursable unless agreed in writing or required by applicable law.

Section 14 Intellectual Property

The website and its original content, including the Damru name and logo, product photographs, videos, graphics, text, educational material, packaging artwork, product presentation, selection and arrangement, are owned by or licensed to Damru or Damru and are protected by applicable intellectual-property laws.

You may use the website for personal, lawful and non-commercial purposes. Without prior written permission, you must not reproduce, publish, distribute, modify, scrape, sell, commercially exploit or create misleading derivative uses of our content, branding, product images or designs. No licence is granted except the limited right to access and use the website under these Terms.

Shopify's names, logos and services remain the property of Shopify or its licensors. Other third-party marks belong to their respective owners.

Section 15 Optional Tools and Third Party Links

The website may provide access to tools, payment services, logistics services, social platforms or links operated by third parties. Their services may be governed by separate terms and privacy policies. We do not control their independent content or operations.

We are responsible for our own obligations to customers but are not responsible for unrelated third-party websites or services that a customer chooses to use. Customers should review the applicable third-party terms before engaging with them.

Section 16 Relationship with Shopify

Damru is powered by Shopify, which enables us to provide the Services. However, any sales and purchases made through our store are made directly with Damru. Shopify is not the seller of Damru products and is not responsible for fulfilment, product claims or customer support relating to purchases from Damru, except for obligations Shopify may independently have under its own terms or applicable law.

Section 17 Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy. Because the website is hosted by Shopify, Shopify also processes certain information to provide and improve its services. Shopify's privacy information is available at https://www.shopify.com/legal/privacy/app-users.

Section 18 Reviews, Feedback and Customer Content

If you publicly submit a review, comment or other content through the website, you give Damru a non-exclusive, worldwide, royalty-free licence to display, reproduce and use that public submission for operating and promoting the store, subject to applicable law.

Private messages, personal photographs and videos sent for customer support, damage verification or order fulfilment will not be used in public marketing without appropriate permission. You confirm that content you submit is accurate to the best of your knowledge, does not violate another person's rights and does not contain unlawful or harmful material.

Section 19 Errors, Availability and Changes

The website may occasionally contain typographical errors or inaccuracies relating to descriptions, prices, promotions, shipping charges, transit times or availability. We may correct such information and may contact the customer before fulfilment where the correction materially affects an accepted order.

We may update, limit or discontinue products and website features. We will not use this clause to avoid an obligation for a product already paid for and accepted; where we cannot fulfil such an order, we will provide an appropriate refund or alternative as agreed with the customer.

Section 20 Prohibited Uses

You must not use the website or Services to break the law, infringe intellectual-property or privacy rights, harass or harm others, transmit malicious code, submit fraudulent information, interfere with security, scrape or extract content without permission, impersonate another person, place fraudulent orders, misuse payment or COD facilities, or attempt to gain unauthorised access.

We may restrict or suspend access where we reasonably believe the website, customers, Damru, Shopify or another person may be exposed to fraud, abuse, security risk or unlawful conduct.

Section 21 Suspension and Termination

We may suspend or terminate access to the website for a material breach of these Terms, fraud, unlawful conduct, security risk or misuse. Termination does not remove payment obligations or rights that arose before termination. Provisions intended by their nature to survive, including intellectual property, liability, governing law and dispute provisions, will continue to apply.

Section 22 Disclaimer of Website Warranties

We take reasonable care in operating the website but do not guarantee that access will always be uninterrupted, error-free or free from every technical or security issue. Website content is provided for general information and must be read with the specific product listing, order confirmation and applicable policies.

Any disclaimer in these Terms applies only to the fullest extent permitted by law. Nothing in these Terms excludes a product description, express commitment or statutory warranty that legally applies to the transaction.

Section 23 Limitation of Liability

To the fullest extent permitted by law, Damru will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable from a breach of these Terms. We do not accept liability for spiritual, astrological, medical, financial, business or personal outcomes attributed to the use or non-use of a product.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer remedies, liability for fraud or wilful misconduct, or other mandatory rights under applicable law.

Section 24 Customer Responsibility and Indemnity

You are responsible for loss caused by your fraudulent, unlawful or materially abusive use of the Services, your infringement of another person's rights, or your deliberate breach of these Terms. Any responsibility under this section will apply only to the extent permitted by law and will not make a genuine consumer responsible for Damru's own breach, negligence or legal obligations.

Section 25 Events Beyond Reasonable Control

Neither party is responsible for delay caused by an event beyond its reasonable control, such as natural disaster, severe weather, epidemic, government restriction, civil disturbance, transport interruption, courier accident, system outage or labour disruption. This does not remove payment-refund or consumer remedies that must be provided under applicable law. Damru will take reasonable steps to communicate and reduce the effect of such events.

Section 26 Severability, Waiver and Entire Agreement

If any provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.

A delay or failure to enforce a right is not a waiver of that right. These Terms, together with the Privacy Policy, Shipping Policy, Return, Replacement and Damage Policy, product listing, order confirmation and any written custom-order specifications, form the agreement relating to the use of the website and the relevant purchase.

If a specific written custom-order term conflicts with a general provision of these Terms, the specific confirmed term will apply to that order, except where prohibited by law.

Section 27 Assignment

You may not transfer your account or contractual rights in a way that prejudices Damru without our consent. We may transfer the business or these Terms as part of a lawful restructuring, sale or transfer, provided that customer rights are not reduced contrary to applicable law.

Section 28 Governing Law and Disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer right to approach a competent consumer commission or another forum, disputes relating to these Terms or purchases from Damru will be subject to the jurisdiction of the competent courts at Dehradun, Uttarakhand.

Before starting formal proceedings, customers are encouraged to contact us with the order number and a clear description of the concern so that we can attempt a prompt and fair resolution.

Section 29 Changes to These Terms

We may update these Terms to reflect changes in law, our products, policies or operations. The latest version will be posted on this page with its effective date. Material changes will apply prospectively unless applicable law requires otherwise. Continued use of the website after an update constitutes acceptance of the revised Terms for future use and orders.
